H4 stamping.

  • H4 stamping.

    Hi - I'm in H1B visa and changing my comany by end of Jan 2009. My H1B visa transfer got started on Dec 19th and still is in progress. I'm getting married on Feb 22nd. I have a valid stamped visa upto Nov 2010 of my current company.

    When I go to India, I understand that there is no need for me to get stamping for me. For my wife's H4 stamping (planned for feb 27), I will be having my I-797 of new company (hopefully), but I will not be having any pay slips.

    Please let me know whether there will be any issues for the H4 Visa. Also, whether it will be helpul if I also go for stamping my H1B, with the new company.

    Please advice.

    Not having a single payslip can be an issue especially with the current economy. VO might think you got laid off from your previous job and found a stop-gap solution to transfer H1b to another employer especially if it is a small consulting company.

    If it is a big company, no issues. Just your offer letter with your start date along with some proof of you working will suffice. You need not go for stamping again but you need new approved I797 for your wife to get her H4. Go with premium processing. Otherwise, this will not happen.

      Thanks for your detailed reply. The new job is for an insurance company and it is a permanant position. The H1 transfer is also done by an leading attorney firm. I need to check whith them whether it is a premium processing.

      If it is not a premium processing and the H1 transfer filing date is 19th Dec, any idea on how many days of processing it takes?

        If not PP, it could take 2- 6 months. Not a good idea as you and your future wife will be stranded overseas.
