H4 Visa expired and not applied but i need to go india

My Great Husband forgotten to file H4 Extension for me. It seems there employer only file for h1 ext not h4. It seems they don't do until employee specfically asks.

now for personnel reason i need to go india. Please advice your thoughts and also please tell me if i can file Premium process for h4 ext.

Has your I-94 already expired? If so, you have illegal stay accumulated. How long has it been? Contact the attorney or let your forgetful husband deal with his company. If it exceeds 180 days, you are banned for 3 years from entering and more than a year would ban you for 10 years.

If your I-94 is still valid, you can just go, get a visa stamp when your husband gets the approval and return. There is no need to file an extension.
