Hi,
My L1 Visa(premium) got expired on 12/29/2008 and I had applied for my visa extension. I have already stayed in US for 2 years. Today I got RFE(request for evidence) from USCIS. My friends say that there are more chances of my approval getting rejected since I got RFE. My company says I will come to know whether my extension is approved or rejected in two months. I was planning to go to India on Jan 30th 2009 for my brother's marriage. If I go to india, I can't come back to US till my extension gets approved.
If I go to India, can I apply for a new L1 Visa and come back once it is approved assuming that the current extension will be rejected or do I need to wait for sometime to become eligible to apply for a new L1 Visa?
Please provide me what are the options I have with this scenerio. Your information is greatly appreciated.
