    Dear All,

    How are you doing?

    I have got a H1B from company 'A' in September 2008 which was sponsored by my company 'A', but due to some unexpected circumstances, the company might get closed.

    In the gap between i get in to another job since company 'A' is closed, my friends are telling that my H1b will stand cancelled as it is sponsored by the company 'A' and now the company itself is closed.

    If the company gets closed then, is there any way i can still have my H1B with me instead of losing it, as i have got it after a lot of struggle!!.

    Any advices will be greatly appreciated!!

    Read the FAQs. Your friends are partly wrong. However, to remain in US, you need to have the H1b transfer filed prior to you losing the H1b status. If you leave the US, you can use the remaining H1b period when you find a new sponsor.

    Remainder option is what you need to be looking for in FAQ and the forum search.

      Thank you very much for your reply and the FAQs link.

      As suggested, i walked through the FAQz but still in doubt anout my H1B, I am a noob regarding H1b, so please don't mind if i am asking a question which most of them got the answer for, except me..

      i read your suggestion, but the problem here is i have not been to US even once. I got 2 questions here which an expert like you might answer:

      1) Am i eligible for H1B transfer without being to US even once? If not please suggest an alternative

      2) If eligible, will the H1B filed by company A can be transferred to me(even when i am in job search for some company B and not in company A), if i come out of company A.

        2. Every H1b is a new H1b. Only difference is you need to have a job for any company to sponsor a H1b. Once you are cap counted, you can use it with any company after USCIS approves it.

          consulate interview

          you will not pass through the consulate interview since you would need client letter to prove that the requirement is genuine.
          people like you go to the USA, go on bench (which means you have gone out of status) and then scramble around for more help on such forums.
