  • H1 Transfer + Stamping

    Hi,

    I used to be with company A working as a consultant at client B. The client hired me full time n they have applied for the H1 transfer.
    They applied for it in november 2008 in a normal process and they still didnt get the H1. I have an emergency to visit my homeland in 2 days..
    I talked to my HR and they paid for the premium processing but im not sure if i can get the H1 document before i leave.
    I already have the H1 visa stamped when i was with my previous employer. So is it ok to leave US before I get my H1 transfer done? or will there be any issue while returning back?
    Also if I leave the country before I get the H1 done, do I have to get the H1 visa stamped again?
    Please let me know if there are going to be any issues.

    You can leave but only return after you get the new approved I797 from B. No new stamping needed unless your visa expired.

    Also search for cloning and read.
