:confused: Change of status from F1 to H4, while H1B is on pending

Hi,

I applied for H1 in Apr 2008. My OPT got expired on Jan 13,2009 and still my H1B is on pending.Can I apply as dependent(H4) to my husband while my H1B is on pending. If Yes with in how many days I have to apply for H4. If my H1B got rejected before applying to H4, for how many days can I stay legally in united states? Please suggest me. Thanks in advance
