    My friend is a teacher in 0-k12 school on H1 B visa. She was asked by a fellow teacher to proctor in a teacher certification exam during week end in the school premises. Persuming it is a school activity she consented. But later on she was come to know that the exams are managed by a different agency and the renumeration for the day of proctoring will be given by a different agency. She is confused regarding her status. Can she accept that renumeration of the day or not? Please advise. Thanks in advance.

    She should not. If the agency can pay the school, the school can pay her in return as a H1b employer.

      Thanks txh1b for your prompt reply.
      What she can do with this cheque, which she got for this one day proctoring duty, which she has not placed in her bank yet. School is a state school and that is perhaps not acceptable. Is there any corrective action, please advise.

        There is not much corrective action to do as such work is illegal and already done. If the amount is high, she might even get a 1099 at the end of the year.

        If it is possible, consider the work as voluntary work and refuse the payment. Ask the agency to donate the amount to a charity of her choice or the school funds.

        But all the above does not "fix" it. It is just a suggestion.

          If payments has been made to charity on behalf of teacher and if the company issues 1099 later then it may be in the name of the teacher only and teacher will have to declare along with his W2 wages.
          The best would be ask the agency to take back the check and ask them not to keep your record for any payment.

          It is not worth losing your sleep over such a trivial amount.

              The agency can create a cotra account and nullify the payment obligation. Just an accounting gimmick.
