will any legal action affects H1 stamping?

I have my previous employer's visa which is valid till Dec2009. Since I left the previous company by breaking the bond, they are behind me now with the legal notice. I am planing to go to India for vacation and get the new stamping.

1) Will this legal action affect if I go for stamping?
2) Although they are taking legal action, shall I come back with their VISA (valid till Dec09) without going to stamping?
