  • Does L1 to H1 transfer affect the 6 year max out period

I came to US in Nov 2003 in L1 visa and the same company applied me H1b and I got eligibility to work in H1b from Oct 2006. I heard from couple of people that if you are already in L1 for 3 years and you get trasfered to H1 you would loose 3 years period in H1 and you would be eligible for stay only for 3 years in H1b. If thats the case my H1b would expire in Nov 2009. Can someone kindly confirm is the information I got is correct.

    Thanks,
    Rajesh

    L1+H1=6 years total.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
