  • Want H4 to H1 - but course not completed - Is this possible?

    Hi,

I tried to browse through the forums first to seek answers to my issue, didn't get info which was specific to my case, hence the question here

I'm on H4 visa and completing my undergrad course in Computer Science in Dec 2009 this year.
I do have 6-7 yrs of work exp in the IT field in India (It was circumstances which prevented me from completing my engineering degree in India, i had to work!)

If I do get an employer who is willing to sponsor me, am I eligible to apply for the H1-b visa?

For the degree requirement , can I show a letter from the univ ? (something like a letter of proposed completion of degree)

I know the eligibility to work for H-1B's starts from around October, can that be put off till 1st Jan next year (when i would have my degree in hand)?

I have applied for a COS from H4 to F1, (which is still pending) , will that be affected?

Or is this not possible, and I would have to go by the F1-Opt-H1 B next year route?

Appreciate your help on this one, many thanks in advance

    Regards
    Prasad

You need to have earned the degree before April 1st. Letters will not work.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
