H1 Cancellation - revoke

Hi Friends,

I am passing through a hard time.
My employer laid off me and issued a termination letter with 9 business days in hand for me to go with H1 transfer.

My employer said that, he will file a petition to USCIS to revoke my H1 after a week from my termination date. ( ie: after 9+5 days.)

My question is...
1. From which date my H1 will be cancelled (revoked) ?
( ie: from my termination date ? / from the date of petition ? / any other
date that the USCIS takes ? )

2. Do I need to act (H1 Transfer ) before termination date/ date of petition /
before any other time frame ?

3.In Premium Processing - After applying petition for H1 transfer, In How
many days ... I will get my transfer receipt no.?

What is the point in opening a new thread again? You could continue with the old one.

1. Complain to DOL on a WH4 form. Your employer MUST pay you and cannot force a LOA letter on you for benching.

2. Read #1 again and brace yourself to do it! That is the only thing that can save you. Read Neufield memo by using the search feature on the forum.

3. If 1 & 2 do not appeal to you, you do not have an option but to pack up. You need a real job (aka project) to get a H1b transfer done to some consulting joker down the street.

4. I don't want to be harsh but I see every day people taking crap from their employers and asking for help and still do not want to complain. You need to make up your mind.

1. Legally, the date of termination is when you lose the status. But USCIS goes by paystubs. So as long as you have your last paystub, you will be considered in status.
2. If company notifies USCIS of your release, they will mention a date and the date of termination or the last paystub, whichever happens to be latter determines your status. If DOT is latter, company needs to pay you till that date.
3. 7 days in most cases. But to use H1b portability, you need to be maintaining proper status currently to begin work for a new employer upon filing of the petition.
