    Hi,

    I completed my MS in Dec 2007 and worked from Jan 2008-Aug 2008. My H1B was filed and I got all the paperwork including I-797. However, I had to return to Delhi in Aug 2008 for family reasons. Now, I have a job offer and I want to go back. I have been told that I can go to US on B1/B2 and change to H1 status when I begin working. Is that correct? What would be the best way for me to begin work?

    WRONG! You cannot and should not even try that. Status changes from B1/B2 are not easy and having an intent to work and entering on B1/B2 is fraud. Don't even try that.

    You can have the company apply for the H1b (not subject to cap), upon approval, get a H1b visa stamp and enter or if it is with the same old company that sponsored your H1b, get a visa stamp and work for them.
