H1 and H4 together

Hi,

I have a H1B visa which is expiring this May 2009 and currently I'm in India. Now I would like to apply for a H4 visa thru my employer(dependant to my spouse) since my employer couldn't find a requirement in US.

1. Now, if my H4 is approved what will happen to the H1 already stamped in the passport. Will the stamping be cancelled on my passport.

2. And what about the existing H1 petition, does my employer apply separately to cancel the same before they process the H4.

3. If they don't cancel my petition and suppose I land into US on H4 - can I get my H1 transferred to some other employer before its expiry.

1. Not necessarily. You can mention your intent to get back on H1b later to the VO
2. Does not matter
3. Read the FAQs. If you have time from 6 years, it does not matter even if the H1b expired. Look for "remainder" in FAQs and forum.
