H1 stampping Issues

  • H1 stampping Issues

    Hi,

    I was in L1 and got H1 and my spouse was in L2 but now they went out of country and she stampped here H4 visa which valid for another 3 years but if mean time i will transfer my H1 to another company before her arrival in US then whether she need to go for stampping again..

    Please help....

    How did she get the H4 stamp if you are not on H1b? I see some fraud here.

      No i am right now in H1 as i got H1 last year and i change of status also approved and working on H1 but my question is that if i will change my H1 company should my wife need to go for stampping again..

        NO

        But she will need to new I-797 (your) copy when she enters.

          The same visa will work fine along with a copy of the new approval I797.

          Read the Cronin memo available on the forum.

            H1 Transfer is only for H1B and visa stamp is for entry into USA & going back for visit to india (homecountry). your wife or you dont need to go for Re-stamping atleast upto duration which is mentioned on visa stamp. keep your new I797 from second employer and necessory docs..

                    Please! Please!!!!! Read the memo. There is a search function. key word is "cronin" It lists everything that you need for your situation. People on the forum can point you in the right direction but can't read it out for you.

                        your new I797... passport with H4 visa stamp (which already done from india I hope) upto expiry date that visa is valid... no need to restamp... I hope you understand that no need to Restamp again with new employeer........
