    Hi

    I am on L1 working for a company and my project will be closed by March end. My employer wants me to go back to India as there are no projects in line. My husband is here from past 4 years on H1B status. I want to resign my company and come back as H4 (dependent). I understand that I cant work on H4 which is fine with me.

    My question is, my husband's current I-94 is only till August 2009 (this year). If I go for stamping in India for H4 in May 2009, would I be given the visa till august 2009 itself? Also is there any chance of rejection due to the less period in principal applicant's I-94? Please help. Thank you

    Yes, Visa will be based on I797 validity and will not result in a rejection due to less time left. Once you enter US, both H1 and H4 can be filed for an extension together if you qualify.
