    Hi,
    I have the following questions, please guide me about 'em:
    Can a software free-lancer ( US citizen) get services of H-1B consultant by having a contract with the consulting company who holds H-1B for the consultant?
    Would there be a problem for the consultant/consulting company (consultant is in the process of H-1 transfer from company A to B) to work with a US citizen free-lancer who is able to pay for the services?

      Little more clarification:
      The US citizen free lancer does not own a company or is not a legal business entity.
      How would he be making a contract if he doesn't have any business payment/admin process in place?
      Normally consultants work in established firms.

        Couple of questions will help answer better:

        1. Is this work for your personal use or are you trying to get something done cheaper and re-selling it to someone?

        2. Are you getting he services as a private citizen or for some business? Seems like you don't have a business but are you going to re-sell it?

        If for personal use, the company providing you services can just send you an invoice and you make a payment. It is similar to any services that you get like from a mechanic or anyone. You get the services done, they send you an invoice, you make a payment from your account.

        If you want to deduct taxes or something like that, you have to open a business for deducting the expenses as a business expense.

        Hope this freelancing agreement is not to help a friend on H1b maintain immigration status and the likes.
