H1 to H4 visa

My wife came back from India on H4 visa in 2006 and then she got converted her H4 visa to H1 visa in Oct 2006

Her h1 visa is going to expire on Sep 2009 and she wants to convert back to H4 visa from H1...She has not been working for sometime now because of the market condition and also she was pregnant..

She delivered a baby in Jan 09 and she wants to go back to india and come back on H4 visa..

Can she go to india and attend for H4 visa..

Any help would be appreciated.

How long has she been out of H1 status without pay? It is illegal. If you are hoping for a GC, you can kiss that a good bye based on how long the out of status period is.
