My wife is currently maintaining H1B visa valid until Oct 2010. Now after working for almost 1.5 yrs she is not happy with her job and wants to resign. She gave a 2 week (3/9-3/20) notice and was accepted. Now one week left she has some problem and was advised not to work for 2 weeks with a doctor's excuse. She has 2 weeks of sick leave with her.
I have an H1B status and I485 pending , so my wife can switch to H4 from 3/20/2009. I have asked my lawyer to apply for change of status effective 3/20/2009 ( as she had earlier given 2 weeks notice) .
My question is DID WE DO THE RIGHT THING TO CHANGE HER STATUS FROM H1 TO H4 EFFECTIVE 3/20/2009 EVEN IF SHE WILL NOT BE GOING TO WORK FROM 3/16 ( SICK LEAVE). as i mentioned before i do maintain a valid H1B and our adjusment is pending
