    If I would save money then I wouldn't get this situation and didn't think about complaining DOL. How much I need to save in my bank? like 10k or 20k? How many months without job?

    They even not taking my insurance. Why do I need to think about them? No sympathy. If I wouldn't come to USA, I didn't have dreams this day. Not only this employer all other desi employers doing the same thing. Whether I get anything from them or not, but I will not let them do it.

            --- Ask to DOL. but I hope u have to wait upto 1week.

              DOL will assign a local officer to investigate and send you a letter. Depending on what state you are in, the response time varies between 2-4 weeks initially and 2-6 months for the investigation and for them to get you the pay. You can send them your overseas address and they will mail the check there if you are leaving the country.

                I live in one state and my company is in different state. I faxed to the state DOL where my company is located.

                As I noticed, Once I file I can use this for H1 transfer. But also they can not retaliate my H1 becos I filed a complaint against them.

                But at any time I am ready to leave USA. Not a big deal!!!!

                I could warn them before I file a complaint to get my pay but that doesn't ensure that they don't do it for an another guy. So filed a complaint.

                  It should be the Wage and Hour Division of Federal DOL that the employer's state falls under.

                  Google for it and WH4 and you should find where it should go. Send a written complaint with all your allegations and proof (emails, offer letters, communications with your employer, date, time, who etc ) for the same. A fax is not a good means to start this.
