You have been out of status for a long time. There is no defined period allowed to continue being out of status just because you complained. You need to reinstate your status by getting paid and get a H1b transfer done immediately.

Write to him using a certified mail demanding all salary that they owe you and give them until end of last week to get you the pay. Send a WH4 immediately if they don't want to pay you.

If not, you need to pack up and leave.

Instead of sending a certified mail , can I send them an email to his company email address asking them to pay my all due salary before a date(giving them 3 business days)? And also mentioning in email complaining to DOL if I don't here or get paid by that date.

common I read all your post, I think you enter by some consultancy (Agent) person searched & sponsored H1B by your Relatives or family members, I am sorry but I seen somany cases like you, my personal suggesion is if u dont have job or you are trying to find it, my personal suggesion is find some temporary job in some hotel motel so, atleast you can pay some ammount & you not spoil your credit with bank. Thanks for your suggestion. Well Guess. May be you met lot these kind of guys. I landed in US in 2005, started at 28$/hr and went up to 63/hr and $100Kplus/year. After finishing regular 8hours job, learning other technologies and doing the same thing in weekends and long weekends. You also need to know that I have a personal desktop and laptop to learn all these technologies. When I wanted to learn a technology I spent a month with formatting and installation of OS and softwares at least 30 times for successful installation while each installation took more than 6 hours. How many times did you install linux(red hat/mandrake) and win xp, nt, 2003 in your life? Do you have that much time free? How many international languages you know? Just English. Then your father was capable of sending you to ENGLISH medium school. You father might saved his all his savings for your studies and your bright future. My father didn't spend that much. Sent me a gov school with non-english medium. How many technologies do you know so far? How many certifications you have? How many trainings have you taken so far? How many types of jobs you changed so far? Don't I have some other life instead of learning all these technologies? Did I born just for learning all these technologies and make these bast **** rich and rich? I too wanted to start a company a year back but the only reason I didn’t start a company is not to cheat all others just for money. I can't able to tell my parents about my situation that I laid-off 5 months back and not having a job now. I can't able to go out since my employer not taking me any insurance.

If I die in an accident here, I do not let them again fall in financial troubles to get my dead body to my home country to see me at last time. What am I giving them at their old age? But they only need to earn money, they need to go in BWM & Mercedes car, have a $1M individual house and 42" of TV and watching Indian channels.

The recruiters just sit infornt of laptop at home, forward the requirements to their consultants, ask them to change the resume and then send your resume to the vendor. If you get thru the interview their commission is upto 5$/hr. Ofcourse they don't need your resume without exact same version as in the requirement. You did bachelors and masters after spending thousands of dollars for your masters. Use all credit cards and work in gas station to pay course fees with a hope that you will get a good job once you finish your masters.

You spend for $7/hr at gas station with a bachelor degree. These guys no idea what is operating system and don't know what to do if the virus is attacked your system. You just need to give them $3-5/hr just forwarding the requirement to you and then forward your resume to the vendor.

How many hours you can able to spend to study a non-relevant subject/technology book without guidance and without taking any break after you have worked some years in a real time job in other technology?

Don't tell me that you spent 14-18hrs daily when you studied your 10th grade or 11&12th grades in India to get a rank below 10 or 100 in an entrance.

Recently I just got a requirement and told the recruiter that I don't have exp in that version. But I had a more than a year exp in the earlier version and worked for prime vendor company. There are no big differences in those 2 versions. He didn't submit my resume. I am happy if he submitted to the client. I could get a chance to explain them the differences. What else I have to tell him to send my resume to the client?

Please tell me your opinion. I will think about it again. I know they might have spent lot of years to get their company to top position. I don't want to screw up their dreams. I can leave to my home county without taking anything against them. I will consider myself unfortunate and unsuccessful in life.

Thanks again for your information. I will be sending an email to pay my all due salary within 2-3 business days. And also I mention if they don't pay me I will be informing/complaining to DOL.

Sorry. I have been doing same thing since almost more than half a day. I have been looking at other forums too.

I will contact my employer first thing on Monday morning, discuss about my all due payslips and pay, and DOL compliant. If he asks me to go back to my home country to avoid paying me. Then I definitely file and leave USA if necessary.
