    Hi, I am currently in a L1 extension status in US. I have appplied for H1B consular processing this year.
    If the petition gets approved and I am still here early next year(Jan'10), will I be able to apply for a
    change of status to H1B (using the approved H1B petition) and get a fresh I94?

      Is there something that needs to specified in the H1B application so that I can apply for COS early next year.

      If you could brief the steps for applying COS, that would be awesome.

        Nothing special. Just checking the right boxes on I129 with fees and amendming the H1b will do it. You need to do your research as I cannot jot down a step by step procedure here. Talk to a lawyer.
