H1-B Transfer and Extension coming in Sept 2009

Hi,

I have my next 3 years H1-B extension coming in Sept 2009. I am on project and never got on bench or anything like that...now getting an offer from company B and they are ready to transfer my H1-B...The question is Can I transfer my H1-B to company B..and when should start working from company B...or Shall I wait till my extension fill by my first company A...or I can do it before extension fill by company A. They are going to file my extension in last week of April..

--- You can file for an H1B visa transfer to Company B using your current I-797 petition which should be valid till Sep 2009.

..and when should start working from company B...

--- You should legally start working for Company B only after getting a receipt number from USCIS for the transfer.

or Shall I wait till my extension fill by my first company A...or I can do it before extension fill by company A. They are going to file my extension in last week of April..

--- Your visa extension from Company A is independent of your visa transfer to Company B because the main reference for both is your current I-797 petition valid till Sep 2009. Nevertheless, if your visa extension from Company A has already been filed, it is safe to wait till Company A visa extension is complete/approved.
