    Hi

    i applied for H1B this year. Can anyone let me know when i will be notified about my case status from USCIS?

    --- When you selected in lottery systems then USCIS inform your employer with Application Receipt Number, you will see your case status entering Receipt number on USCIS website, even you can see the Processing Dates for Applications and Petitions on USCIS website. I advice you read USCIS website regularly to know more about process & lottery systems. even they already mentione about lots on FY 2010 H-1B.

      There isn't one so far this year. Only the applications received on the day of quota getting filled will likely go through lottery.

      I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

        --- I follow USCIS april 8 2009 notes lines:
        Should USCIS receive the necessary number of petitions to meet the respective caps, it will issue an update to advise the public that, as of a certain date (the “final receipt date”), the respective FY 2010 H-1B caps have been met. The final receipt date will be based on the date USCIS physically receives the petition, not the date that the petition is postmarked. The date or dates USCIS informs the public that the respective caps have been reached may differ from the actual final receipt date.

        To ensure a fair system, USCIS may randomly select the number of petitions required to reach the numerical limit from the petitions received as of the final receipt date. USCIS will reject cap subject petitions that are not selected, as well as those received after the final receipt date.

        Petitions filed on behalf of current H-1B workers, who have been counted previously against the cap, will not count toward the congressionally mandated FY 2010 H-1B cap.

          USCIS Updates Count of FY2010 H-1B Petition Filings

          WASHINGTON April 9, 2009 — USCIS announced an updated number of filings for H-1B petitions for the fiscal year 2010 program.

          USCIS has received approximately 42,000 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. The agency continues to accept petitions subject to the general cap.

          Additionally, the agency has received approximately 20,000 petitions for aliens with advanced degrees; however, we continue to accept advanced degree petitions since experience has shown that not all petitions received are approvable. Congress mandated that the first 20,000 of these types of petitions are exempt from any fiscal year cap on available H-1B visas.

          For cases filed for premium processing during the initial five-day filing window, the 15-day premium processing period began April 7. For cases filed for premium processing after the filing window, the premium processing period begins on the date USCIS takes physical possession of the petition.

          USCIS will provide regular updates as the processing of FY2010 H-1B petitions continue.

          The bold text above says that they are business as usual this year until the cap hits the final number. Lottery will happen only amon the applications receieved on the final day(s).

            H1B paperwork aND DATES

            Dear Friends!

            I really need an advice.
            I applied for H1B on April 1, 2009 - they are still accepting the applications.
            When I was filling out the LCA form, they asked me to put the date when the employment would start - i put october 1, 2009, but the form was rejected as it was too many days from the date I was filling it out. So it only got certified when i put sept 1, 2009. And i sent them this certified LCA form =(((
            On the offer letter from my company it says 'The starting date is the 1st of September (or as soon as the H1B visa is issued) ' and I did put sept 1 2009 on the i-129 form as i got LCA form certified only when I put those dates.
            So should I cancel the checks or should I wait till they open the envelope?
            What if they get me rejected - will I get the money back?
            or maybe I should cancel those checks and resend them the new package?

              Did you do this all by yourself?
              H1B is employer's petition, employer needs to do all this. Contact them asap.

                My employer did that for me of course.
                I am asking if I possibly could chancel those checks and send them new correct documents for premium processing? My I-94 expires on June 25 and I need to know the results before it happens
                What do you think?

                  Do you have I-94 from another status? Was this mentioned on the I129?
                  You do not need to cancel anything, if this is your first H1 petition then start date cannot be before Oct 1, 2009. Your employer's lawyer should have known that. They may reject his application or send an RFE.

                    What is a RFE?
                    The thing is when we were filling out a LCA form online - it did not let us put october 1 and we had to put sept 1, 2009. That is the whole point ;(((
                    My I-94 is for visitor visa, it expires on June 25, 2009 and yes - it is mentioned in I-129

                      All this sounds like a very inexperienced/unprofessional employer to me. I have never seen how LCA is done, since I am not an employer or their lawyer. But since many employers have been doing this for years, you must have chosen some wrong options.
                      RFE is when they want you to correct some documents or send additional documents. What you really need is an expert lawyer to handle all this for you.
