FACTS: I have my H1B stamp from Employer ABC and that will expire in OCT 2009. I am working now for employer XYZ and petition is valid till MAR 2012. i -94 till MAR 2012. I have multiple entry visitor visa for Canada as well.

I am planning to go to India in Dec 09. But head the story of H1B re stamping problems. So here is what I am thinking to get it stamp from Canada. Need your help in this.

As traveling to Canada by road they are not taking i -94 and no immigration while coming back. So even if they give some trouble in H1B re stamping at Canada I can come back to US and cancel my trip to India. Am I thinking correct or not..?

---- No, you are wrong. If you are restamped in Canada, you are stuck in Canada and if you want to go to India, you have to go from Canada. It also depends on the VO, if they tell you to proceed to your home country to get the H1 restamped

---- All in all you cannot come back to US, if you do not have a US visa

here is more informaion...
What if I go for re-stamping in June 2009 ?.In this case if I have problem while stamping ..Can I drive back US as my visa still be valid with i-94 till 2012..
Will they return passport i-94 as is ?
Or do embassy takes i-94 ?
