I have applied transfer and it is approved. However the petition is in transit and I have to go India. My old employer has not revoked my H1B and I797 is with me. I will need to know:

1. Can I show old employer's I797 to enter stating I have not joined new employer so far.

2. Can the photo copy of I797 is ok at the POE.?

1. Possible but carry your new employer's receipt. Your H1b val;idity period could be greatly reduced as your I-94 is given only till the visa validity.
Better have someone send the I797 approval to your home overseas after making a copy/scan of it to ensure it does not get lost.

2. A copy will work fine if you have lost the original. I have gone through it once in the past.

I140 - While in India

I am not sure if this will be right. I am in India and started GC process.

I have two question .

1. Can GC be done while India.
2. Do I need paystub for while filling I140.
3. After ad can I get the PERM.

Was not able to start new and hence asking this question.
