  • concerns about second h1 stamping

    Dear All,

I am planning to go to India (Chennai) sometime soon for a second h1 stamping. My case history is as follows: -

Did my Masters in US and worked on OPT and H1 (almost 2 years) with a company in California. During this time I had a successful stamping in Tijuana, Mexico. I then got laid off in November 2008 (end of November). I initiated an h1 transfer in December with a consulting agency in another state (Oregon). My application was received on Dec 19th and in March my second h1 was approved. From December 2008 till Feb 1 st week I was on bench. My employer was not paying me during this time. Got a project in a small company in California itself in the second week of Feb.

    Now, my concerns are-

1> Since I won't have pay stubs for the months from December 2008 - Jan 2009, can there be any issues during the visa interview? Should I ask my employer (consultant) to generate pay stubs for December - Feb 1st week?

2> The Consulting company has shown much lesser salary on the LCA. Almost 20K less than what I was getting. When I asked my employer, he said in this state (Oregon) this pay scale is appropriate.

3> My client is also not paying me substantially. Actually I am making lesser than what I was making before.

4> My employer's has about 20 consultants and my client is a small start-up who has 4 other employees.

Considering the above, I am a bit concerned about the visa interview/stamping.

I would appreciate your feedback on this.

    Thanking you all in advance.
