    Hi Seniors,

    I would really appreciate your response to this query. When your employer applies H1B for you, before the approval of H1B, is your employer required to give you an employment offer letter and other documents to you. So you have a record that you applied wih this employer. Please provide the link to the info on DOL/USCIS website if any.

    An offer of employment is given by professional companies before they file for approval of H1b and get you to sign it. They need not give you any documents. After the approval, the LCA copy and approval has to be provided to the employee.

    The shady ones can do anything to circumvent this.

        Actually, you did not apply with the employer. The employer applied for you. Offer letters are insignificant and have no legal binding anyway.

              I mean how do the employer settle pay of the employee (whatever %age). You know these IT consultant companies- I am talking abt those.... You got me, right. so, coming back to the question, if you don't have any offer letter from your -the so called- employer. How are you gonna get paid after you het your H1B and start your job. Hope I explained it right.

                A job without an offer letter is a BIG NO!!!! Even a burger flipping job probably gives a written offer letter these days.

                As far as pay goes, the percentage schemes are all not right. The employer has to pay a fixed amount on W2 on a weekly basis at the very least, the amount on the LCA.

                  --But I am sure, you know it, there are many people out there who have no options but to apply with "those - It firms". What are your suggetions for that lot, to get paid.

                  -Do you have any links to DOL/USCIS sources stating anything about the offer letter from the employer.

                  -And when should one get that offer letter. Before the real job or before the H1B approval.
