Can i have H1 and H4 at the same time?

Hi All,

I m holding H1 and have SSN also, because of recession i came back to india. My wife is having F1 and soon she will get H1, can i go on dependent without canceling my H1?

You will have only one visa at a time.

---- Yes, you can apply for H4 and come to US on H4 if your spouse has been granted an approved H1 petition. You can retain you H1 and later do a COS from h4 to H1 when you get a job and the employer is willing to transfer your H1
