  • Attending for Visa after H1 Transfer

    Hi Experts,

I have changed from Employer A to Employer B ( US based employer) and H1 transfer to Employer B completeded and recieved new I 797 and I -94. My Exisiting Visa is valid until July 2010. And New petition and I -94 valid until 2012.

I am planning India trip in August 2009.

    1) If I travelled out of country, do I have to go for stamping and have a new visa stamped to travel back to US? OR since I already have valid vaisa, Can I come back with that ( showing new petition with that?)

    2) Basically I am from South India belongs to Chennai consulate division in India, Can I go for stamping to mumbai consulate? Some of my friends told that, since this is not a new H-1 and just H-1 transfer, I can go to any consulate for stamping in home country. Is that true?

    Please advice.

    Thanks much!

    Hi Chandru,

    (1) You do not require to go for Visa Stamping again as u have a Valid Visa till July 2010.
So while coming back show the exisiting Visa and new I-797 approval and make sure at Port of Entry u get a new I-94 till 2012 .
If u go after July 2010 - then u require a new visa stamping.
Remember u have to hand over all ur I-94;s while going back to India.

    (2) That's correct. When u go to India next time after JULY 2010- u can go to any Consulate as u will be under the category - Indian Citizen Resident in US.

    Regards,
    Abhay
