  • PLEASE HELP: COS from H1B to F1

    hi all,

I was on H1B and I got laid off in Apr 20th. and applied for change of status from H1B to F1 within the same week (i guess they received it by apr 27th)

INS sent me a letter asking followings to be provided:
    1. evidence of the three most recent pay statements to eastblish thta I have been maintaining valiud status
    2. evidence of the baccalaureate degree that i used to gain admission as
    an H1B nonimmigrant.
    3. a detailed explanation conerning my need to abtain an associate degree's

to obtain F1 visa, I applied to an associate degree. However, I did my masters here in the US in 2005. is it concerning that I am applying to associate degree given the fact that I have my masters.

My school advisor asked me if the notification sent to me is blue. no, it is not, it is a white paper, he said that it might be concerning...

I am concerned now. Can anyone help me if you had a similar case?
    Thank you!

Do you have a bachelors degree? They are talking about the degree used for getting H1B job. (requirement for H1B is at least a master's degree. Send copies of all your degrees)
Advisor was asking for color of paper, since they probably do not know much about COS cases. In visa applications pink and white slips are usually issued.

    Don't worry.

This is my opinion and not legal advice.

      H1B to F1 COS

      Hi,

My H1 transfer with company B was denied today. My company has not received the official denial notice and the reasons for denial but I saw the status online.
I believe my company will reopen the case but to be safe I was planning to apply for change in status to F1.

      1. Does anyone know what happens if I change my status from H1 to F1 and then I get my H1 approved based on reopening my case?
Is my status now F1 or H1?
      2. Can the company B apply for a fresh H1B for me? (I am assuming that my prior company has not revoked my H1B visa and I have approached them for rejoining them)

      Thanks!
