  • H1 Transfer date of Join Question

    Hi All,
I had my H1 transferred for Emp A to B. Now Emp B wants me to join them immediately. But Emp A wants me to work with them for a few more days

Both Emp A and B are open to me working half a day for each of them for a week. So with respect to the logistics i have no issue. But with repect to paycheck will it be legal for me to receive paychecks from 2 employers for the same period

    Pls advice
    Thanks
    M

--- Unless your H1B petitions from both A and B are for part-time employment, you cannot work for A and B at the same time. It is illegal to work and get paid for that period of time.

      Thanks Rajesh...
Would it be ok for me to volunter my service without being paid for the overlap period. Also if I'm paid by both employers, is this one of those aspects which gets erased when I reenter the country with a new I94 stamp

--- I think (but am unsure) that you can work as a "volunteer" without being paid for the overlap period. Please get this clarified by other seniors who visit this post or better yet, an immigration attorney.

I don't think anything gets erased when you get a new I-94. Getting paid during your overlap period might result in a query from the IRS during tax filing. Again, get this clarified by other members in this forum.

        Good luck
        Rajesh
