travel during H1B Transfer

Hi,

I did my Masters here and got H1B. I dnt have H1B stamping in my passport. Now I am transferring my H1 to company B and will be working from July 1st. I have to go to India in the 1st week of August during which my H1B transfer will be under process. Will there be any problem while returning back? What are the solutions if I have any problem?

I would suggest you go for a PP on your transfer and get a visa stamp in August during your visit to facilitate an easy return.

It is not possible for you to use the old employer's I797 for a visa stamp when you are working for a new one. Other possible options on a pending transfer do not apply to you as you do not have a visa stamp on the PP.
