H1B Tranfer RFE

  • H1B Tranfer RFE

    Hi,

    i got layoff from my job in Feb, that was my fulltime job and with my Paid Time Off they said upto march 11 i can be in Active status.

    On march 12 i filed new H1B Transfer with Company A

    And i got Fulltime with Company B on May 4 and i joined with them and i got receipt for that H1b on May 4.

    i did not used any of my company A info during the company B

    i used same set of docs for both H1B Transfer.

    Now i got RFE for company B by asking paystubs for march and april.

    please advice me how can i proceed with this????

    You have to provide the "bridging" status paystubs as you are depending on it for continuous status on your H1b and using AC21. If you cannot provide a paystubs, the case might end up in a denial.

      Thanks for the quick reply.

      If Company A gives the paystubs for march and april , with those i can reply to my RFE right.

      as i did not mention any info about company A in my H1B application, if i submit the payslips is that going to be a problem again ??

      is "bridging" status paystubs is different than normal paystubs?

        What do you mean by "giving"? They should pay you if you were to maintain legal H1b status. Paystubs the the same.

        If you don't mention company A, how will you prove you were in status in the gap? Also, you not mentioning but USCIS is having a transfer petition request from company A, do you think they cannot check?

          I was laid off by Company A and I have got job with Company B and filed H1b transfer within 30 days of grace or appeal period of time. I have I-94 expiration date till Dec 2011. I came to know Company A cancelled my H1b on the same date when I left.

          I have got RFE for Company B H1 transfer for client letter and other work evidences. We have submitted the purchase order from the middle vendor, timesheets filled and signed by the client, agreement between middle vendor and client.

          The current case status on the USCIS site is :

          Response to request for evidence received, and case processing has resumed.

          I have got another job with Company C with direct client. The client is ready to give letter for work evidences.

          Since I have less chance of getting approval with Company B, Can I apply H1b transfer with Company C?

          Please advise me. It would be really grateful.

            You can transfer to C, go PP to be safe.
