Hello,
I am working as a civil engineer since 2003 on H1B. due to various reasons I haven't applied for green card. my six years visa time will be over by september 30, 2009. I know I cant renew the visa after that and need to be out of country for 365 days before I can apply for H1B again. My employer wants me to come back again after 1 year.
1. We are leaving to India on september 15, can my employer apply for new H1B again in april 2010 for october 2010 start date, as it will be more than 365 from sept 15, 2009 to oct 1, 2010. or even the for applying I need to wait 365 days.
2. If I can then can I apply under MS quota as I have MS degree from US university.
Please help.....
