Wife's father's name incorrect on Passport ! Urgently need HELP ! SOS !

  • Wife's father's name incorrect on Passport ! Urgently need HELP ! SOS !

    Dear Immihelp/Immihelp Forum Members,

    I am in need of some extremely urgent information and I'd be extremely glad and thankful to any of you who could assist me with my issue.

    Case information:
    • I am working in the USofA on an H1B.
    • My wife will shortly be applying for her H4 from the Delhi Consulate.
    • Her passport has recently been issued.
    • After issue of her passport, we found that the spelling of her father's LAST name has been MISSPELLED on her passport.
    • My (husband's) name has NOT been endorsed on her passport. It isn't even a requirement for the H4, so I wasn't concerned about this. But now I am !


    My questions are:

    1. Will an incorrect father's name on my wife's passport pose any problems towards the issue of her H4 Visa ?

    2. Will it be alright to go ahead and seek an Interview Date at the US Consulate in Delhi for the issue of her H4, not worrying about the incorrectness ?

    3. Will the authorities/visa officer question/quiz her on the correctness/incorrectness of her father's name ?

    4. Do we need to get in touch with the respective passport office for the correction in her father's name in relation to the H4 ?

    5. I know that in future this may need to be corrected, but is it necessary immediately as far as issue of the H4 is concerned ?

    6. Does an H4 applicant too need to fill out the SAME DS-157 form as we H1B applicants filled out ? Or is it a different one with different areas to fill out. Why I ask is because only on the 157 do they ask you for your father's name. In case of an H4, the father's name column may be replaced with Husband's name ? Yes/No/Maybe ?

    7. Is the Father's name that an applicant is supposed to mention in the DS-157 form, verified or cross checked with the applicant's PASSPORT ?


    These are my questions .. I am in a dilemma as this incorrect name issue is now worrying me. As we all Indians know, the Passport Office is a BLACK HOLE .. a hell hole .. and everything there takes AGES ! More on that later .. but first .. i'd be SO thankful to any of you who can offer me help regarding my issues !

      Hi,

      For changing the names/correction in newly issued passport , from my experience -
      I had to change the last name (incorrectly spelled) , I told them that I need to take the Visa Interview and had to travel soon.
      So they just put the stamp in one of the pages stating that correct name is YYYY YYYY XX and signed by the concerned authority/passport officer.
      It took 1 day for them to do it.
      It was in Hyderabad Passport office.

      So u can try it out in ur passport office area , but as correctly said Father'Name will not impact the issue of H4 Visa .
      It;s only the main applicant name which causes issues if incorrect and needs to be corrected before going for an interview.

            Original I-797 and Employer Verification Letter required ?

            There's more that I need to ask you as no where have I been able to find a reasonable answer.

            Is it necessary for my wife to carry the original of the I-797 petition and the Employer Verification Letter ?
            While I came to the US, I carried all my original petition papers as it was told to me that at the POE, I will be required to present them, and I was. So, in order for my wife to have the originals, I might have to FedEx them to her .. which doesn't seem reasonable.

            Could you tell me if it is mandatory to carry the original petition and employer verification letter ? Or would scanned print-outs of the originals suffice ?

            I'd be glad if you could kindly let me know.

                Hi Devashish,

                We say its better to carry the Original I-797 but its not mandatory.
                As Consulate can verify the details using the their system and other information.

                Recently I have seen a thread where main H1 applicant has taken the photocopy of the I-797 at Delhi Consulate and was able to get the H1 Visa.

                So , if you are not comfortable sending the original I-797 , then atleast you can send the Original Employment verification letter , PayStubs (photocopy will do), ur bank statements (pls check other docs required for H4 in immihelp list) .

                Others can give u better answer who have done actually with the I-797 photocopy. As per my opinion ur Wife interview should be OK with the photocopy provided she has all other documents.(marriage cetificate ,wedding albums etc etc)

                Please note you can post ur query once - not required to post it for specific member .Whoever sees it will reply to it otherwise it will go in multiple pages.. ..
