  • H1B renewal

    Hi all,

This may be a silly question for you guys. But I don't know the answer.

I got my H1b Visa in sep-2005 (which was valid till sep-2008).
I changed my company in Feb-2007 (this new i-797 has validaty until Feb-2010)

So my question is if I apply for renewal in Jan-2010, will I get approval till 2013 or sep-2011(based on my first visa) ?

    Thanks

The date on renewal petition depends on a lot of factors these days. In general, if your H1b has 3 years or more remaining out of the 6 years, the approval would be for 3 years if the company submitted the labor and petition asking for 3 years.

Now, the validity is being determined by many other factors including labor, contacts, work order validity (for consulting jobs) etc.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

You get a total of 6 years. If your I-140 is approved you may get extension beyond 6.
This is my opinion and not legal advice.
