    Hi Guys

    I need some advice on my current scenario. I have my H1 valid till Dec 31st, 2009. I am planning to get married in October 2009 and return to USA with my spouse in November 2009. If I apply for extension (renewal) through the regular process I might end up travelling during my extension process which would create issues due to difference in the I-94. In order to avoid this I have opted for Premium H1 Processing which will hopefully get me an approval in 15 days time. Considering my H1 is approved for another 3 years my question is, what will my spouse be stamped on her passport when she would go for the H4 stamping in November 2009. Will it be till Dec 31st 2009 or will it also include my next 3 years of my extension.

    Please advice.

    You need to submit both I797s and while filling the DS156, use the latest I797 with the approval date for 3 years. At the visa interview, submit both I797s and the visa will be issued till the current period + new I797 period.

        On a second thought, can I travel out of US while my LCA/H1 B (renewal using premium process) is in process. I want to avoid counsellor processing in the future. Please advice.
