Spouse H4-H1-H4(Primary Changed Employer)

Primary and spouse enter USA in 2007 on H1 and H4 from employer A.

Primary changed to employer B in 2008. H1 & H4 both approvals obtained with new employer B.

Spouse applied for H1B with employer C in 2008, was approved in 2009. In a few weeks after approval, spouse travelled to home country.

Can spouse re-enter on H4 with valid H4 stamp from employer A and H4 approaval from employer B.

Primary is maintaining H1B status with employer B.

H4 can enter with I797 copy of H1's current employer B and a visa from ANY employer. H visa is not tied to an employer at POE but rather to the documents presented by/for the current employer at POE.
