My situatuin is like this.....
I am currently visiting India for 2 months. I have been in US for last 7 yrs on J-1 visa and got an extension of J-1 visa till10/31/09. In then mean time I had applied for j-1 waiver, now the waiver has been approved and my attorney is filing for H-1 b visa premium processing.
My question is will it be safer to file for h-1 b visa with consular processing and get my h-1 stamped while I return from India to usa or would it be safer to consulate and get j-1 stamped(as it is valid till 10/09) and then file for h-1 b visa with cos in US?
pls advice.
