    I have the H1 visa from my first employer on my passport. It is set to expire at Sept 30 2009. I have I-797 (H1 approval) form from my recent employer. The I-797 from the recent employer is valid until Sept 2010.

    I am going to India last week of August and coming back on the 8th of September 2009. Is there a rule that I have to get the new visa stamped on my passport as the visa on the passport is set to expire within 3 weeks the time I coming into USA.

    FYI - I have been to India with the same old employer visa couple of times but showed the I-797 from new employer at the time of entry.

    You already answered your question above. No new stamp needed unless you want to get one to avoid problems with transit visa in the future when you want to travel through the EU countries.
