  • FINRA Exam for H4 Holder

    Hi,

    I am a H1-B holder who received I-140 approval June 2009. My Priority Date is July 2008.

    My Green Card is under EB2 Category and current priority date is 08JAN05 according to http://travel.state.gov/visa/frvi/bu...etin_4558.html

    I have a question regarding my husband who has H4 Visa.

    He is a MBA (Finance) guy working as manager in India for Stock Brokerage Company.

    I heard that Financial companies in US are asking for Series 7 exams. But for him to write those exams the companies should sponsor and for that he needs to have SSN.

    As I understand dependents are not issued SSNs lately. I was wondering if I can apply for a ITIN (Individual Tax ID Number) for him, so he can appear for the exams and also get his Drivers' License. Can I apply for it anytime or just during the Tax Filing ?

    Also I would like to know what job opportunities he can have if he wants to settle down in US.

    It would take me a while to get EAD, so he can get a work permit. Is it advisable to apply for H1 for him ? as I heard the H1 quota is still available. I do not know as to what visa category is better for him.

    I appreciate any help.

    Even thought it's advised to apply for ITIN at the time of filing taxes, I know some of my friends who got it before that.

    But H4 person needs to be in US to apply for it.
    Also ITIN is not SSN replacement to get driver's license. He might need an affidavit (depends on state). Check DMV sites for more info.

      H4s cannot get SSN and ITIN is not to be used for such exams. You have to look at H1b options for him as getting an EAD will be a long wait based on your PD.

        -- H4 Visa holder is elligible to apply for Drivers license in all states of US (for that H1B person's I797 & H4 visa is enough and his/her identity proof that is passport).
        H4 visa holders can't earn or can't do any Taxable or equivalent activities.
        There is NO SSN or any Individual Tax ID Number rules for H4 visa holders.
        H4 visa holder elligible to study in the USA in any stream but it should not be affect his/her H4 status means NO EARNING OR NO TAXABLE realated Activities.

            -- Read it carefully , Are you looking for Class D. there are some rules depend on class. Look for Class C drivers. In whole USA H4 person can drive on Class C type of Driving License (that is for Car & equivalent vehicle).

            When you go to apply for Drivers license they will help you, when I came first time the DMV office people don't know about H1B visa and about I797B too. even I went for my wife Driver's license that time they dont know about H4 is which category visa, but they read some papers (they have ready on the desk of the DMV office) and my wife is allowed for test and she get license.
