Need to travel to India , H1 -H4 COS pending.

Hi ,

I applied for COS H1 to H4 in May and the online status shows as pending. Due to some family emergency we need to travel to India in 2 weeks.
My husband is on H1, but in his visa extension petition I was not included as a dependent because at that time I was on H1.
Kindly help me with the questions below on how I can apply for my H4 visa stamping.
1) Should I wait for the COS to be approved before I can apply for the visa stamping?
2) While applying of the interview what details need to provided in the petition details, will this be the details of my COS petition or my husbands H1 extension petition? like 'Principle Applicant’s Name:* should this be my Spouse's name?', 'Petition Receipt Number:* COS petition number or Husbands H1 extension petition number?

Any help is appreciated. Thanks in advance.

You can take the receipt of COS application that was filed and travel. Attend the H4 visa interview based on your husbands H1b petition with his petition details as he is the one that petitions for a H4. Show the H4 COS receipts if asked by the VO.

My husband already scheduled an interview appointment for his H1 B stamping few days back . Please advise if you think its ok if I apply for the same day for the appointment for my H4 stamping now. I believe the time slots may not be together . Will it be ok if I go along with my husband for the stamping since his time slot is in the morning? or is it advisable to cancel his appointment altogether and apply together for the stamping?

The security outside will not let you in if the time of appointment is hours away. In your interest, if both of you want the time together, he should cancel and book an appointment together to avoid the different time.

If not, you could go separate and it will not be a big deal except for his original I797 which might be needed for you as well.
