Guys Please help me.
Technically my H1B visa expires in May 2010. My company was applying for my labor in May 2009 after going through the stressful 6-8 months recruitment/advertisement process but suddenly my project ended in MAY 2009 and they stopped my GC Process.
Now if I apply for labor, its has crossed the 365 days limit.
I cant go for h1b transfer and if my current company doesnt put me in other project and start my labor, I have no option but to leave the country for one year to apply for fresh H1B again.
I need your help/advise. If i leave in Oct 2009, I would have around 5 months h1b left with me. Can I apply in April 2010 for fresh h1 b visa and enter usa in Oct 2010 or I can enter before that using my previous h1b period.
Please any advise would be appreciated.
