Hi ALL,

I am on H1B since Oct'08 to ABC company. Due to this market situation I am not able to get any project and i am on bench.

1.) If I want to be in India for 1 year what will happen to my H1B?
2.) Did USCIS asks to ABC Company about me or my payroll?
3.) Will it harm to my H1B if I work in India or any other country?

1.) If I want to be in India for 1 year what will happen to my H1B?

--nothing

2.) Did USCIS asks to ABC Company about me or my payroll?

--No. They will ask you to provide most recent pay stub in case of transfer.
--Is employer paying you on bench? if not then you are out of status and you will face problems in future. In that case you can complain to DOL.
--It is also true that USCIS has appointed contractors to inspect all h1b employers and employee randomly to find out visa violations by visiting on-site. But it may take time to reach to your employer.

3.) Will it harm to my H1B if I work in India or any other country?

--No, but make sure you have a copy of an approval with you.
