Hi,

Is it possible to apply a new H1B in April 2010 if the person is in USA till March 2010 ? Should there be gap of 1 year for applying a new H1B or the gap is just stay out of USA for 1 year ?

---- If your 6 yr term for H1B expires in March, you can shift to H4 wiht your spouse on H1 (provided they have some period left on H1). If you want to apply for a fresh H1, you have to be out of the US for 1 year in either case
