H1B Visa Planning to re-enter to US

Hi All,

I need some help from you guys regarding, I have my H1B visa stamped and i am in US now.My I-94 is valid till Sept 24th 2010. I am planning to visit India in July 2010 and returned back in August 2010.Do i have any problems in immigration or any port of entry problems???

Forget about I-94. You will have to return it when you leave U.S. When does your visa expire? As long as you have a valid visa, there shouldn't be any issues. Assuming your visa also expires on Sept 24th 2010, you will get new I-94 only till that day (or somewhere around that), unless you already have a approved H1B extension.

Thanks for your reply. My visa also expires on the same date on Sept 24th 2010. Do i need to get my H1B extension approval from my employer before i leave to India in July 2010. Please advice.

It is better to apply for an extension earlier. By the time you come back, there is only a month left on your visa. You can still come back and apply for the extension. But earlier is good.
