  • H4 Stamping first time

    Hi,

I have been in USA last 2.5 years. I went to India in 2008 September and got married and came back to USA in Jan 2009. I started searching for job due to recession took 6 months to get assignment. I was not paid for this period. I got job in July 15th, Now I have two pay stubs.

I am planning to send my wife for H4 stamping.

    Will there be any problem?

What documents needed for H4 stamping?

Two pay stubs enough or more than two is needed?

    Please help regarding this.

    Thanks & Regards,
    Vish

Yes, principal H1b paystubs are needed. H4's status is directly dependent on H1b holding valid status. If H1b violates the status, so does the H4.

You need to be paid all the time on your H1b. that is the law. Complain to the DOL and get paid that look for loop holes to bypass the situation.

The VO can easily notice that the YTD salary on the paystub is so low and question what is going on during the H4 visa.
