  • Need to apply H1B. Pls answer my questions.

    Hi Guys.

    My wife is on H4 in usa. I want to apply her H1B. She did her bachelor in Commerce and then completed MBA in HR. Then worked for 2-3 years in india.

    We have a friend who has some small business(little company) in USA. Just wanted to know if he can sponser my wife's H1 visa for post being Business Manager (to manage his small busness). Please reply for:-

    1. Whether He can sponser H1B for my wife keeping in mind his small company?
    2. What are chances that the visa will get approved keeping in mind that she did his bachelor in commerce and MBA in HR?

    In the current econmy, I can see a denial than an approval due to the employer's small business, number of employees. Is there an office or is it being managed out of a home?

        They have 2-3 stores/locations but it is mainly managed from home.

          In case of H1B petition fees, if your H1B petition is NOT picked up in the lottery, your employer will get all the documents back along with the application fees (You don't need to worry about lottery now, since the H1B quota has still not reached). If the petition is processed and not approved, the fee is non-refundable. The fee is for processing, not for approval.

            Thank You Guys.

            So Is it worth taking risk? I mean at the most if H1B petition is not approved, what I loose is aroun 2000$(is this total fee?). But if its approved, its better. What are the other risks involved?

              Paying for H1b is illegal. Employer has to pay most part of all the fees. The job should be complex enough to have a person with a degree manage it to even qualify for a H1b. Most of the store jobs can be managed by people that need not have degrees.

              Chances of approval are slim to none for this kind of job.

                ya i mean if the employer pays. thank you guys. i will also talk to the immegration lawyer in ths regards and take a decison. will keep you posted. thanks
