I got L1-H1 transfer approved last year (Oct 2008), and did leap frog (Last action rule) to continue on L1. I have new I-94 with L1 visa. Now I am planning to work for my H1 employer.
My H1 employer is planning to apply for H1 under Non-Cap category. He is saying I can start working as soon as they file the amendement. Is this true ? As per my knowledge, I need to wait till we get approval. Is there any possibility of this ? I tried to convince the employer with some references to public forums, but no luck. Can some one advise on this. I am exhausted with all options of convincing him. By the way, employer is la eading consultancy and legitimate. Employer and the attorney are very sure abt this, but by reading so many posts, I am not so sure on this. so thought of checking with you guys before proceeding . Please advise.
