Hello,
My H1 is valid from Jan/2004 to Jan/2010. In order to reset the 6 year H1 clock, I travelled out of US in July/09 and plan to stay out till July/10.
As I understand, my new H1 application will be cap subject.Hence, it can be applied on or after 1 Apr 2010. Is that correct ? or I have to first complete my one year outside US in July 10 and become eligible to apply, and then only if the quota is still open, the application can be filed?
Please tell me which condition is true?
